Agencia Peruana de Noticias PRENSAPERU.PE https://prensaperu.pe Twitter: @prensaperupe El máximo ente electoral del Perú informó, que tras la reapertura, del Registro de Organizaciones Políticas (ROP) del Jurado Nacional de Elecciones (JNE), se procedió a cancelar la inscripción de 15 partidos políticos que no cumplieron con los requisitos de ley para mantener su vigencia, luego de la realización de las Elecciones Generales 2021 (EG-2021).

Así, una vez revisada el Acta de Proclamación de Resultados de los citados comicios emitida por el Pleno del JNE, el ROP advirtió que 10 agrupaciones políticas no lograron cinco representantes al Congreso en más de una circunscripción y tampoco alcanzaron el 5 por ciento de los votos válidos a nivel nacional que exige el artículo 13°, literal a) de la Ley de Organizaciones Políticas (LOP) para mantener su registro.

Por esta razón, la mencionada instancia canceló de oficio, mediante resolución, a los partidos políticos: Democracia Directa; Frente Amplio por Justicia, Vida y Libertad; Frente Popular Agrícola FIA del Perú; Partido Nacionalista Peruano; Contigo; Partido Popular Cristiano; Perú Patria Segura; Renacimiento Unido Nacional; Unión por el Perú; y Victoria Nacional.

En el caso del Partido Morado, el ROP señala que esta agrupación solo cumple una de las condiciones señaladas en la citada ley para mantener su inscripción, es decir, en las EG-2021 obtuvo el mínimo del 5 por ciento de los votos válidos a nivel nacional. Sobre el particular, precisa que lo establecido en la LOP es categórico en cuanto a contar con las dos exigencias referidas anteriormente, por lo que procedió a cancelar esta organización.

Agrega que el legislador al modificar el citado artículo de la norma en referencia, mediante la Ley 30995, buscó incrementar los requisitos para que un partido conserve su inscripción, lo cual se desprende de su exposición de motivos en la que señala que de esta forma se podrá “acercar a un sistema político con menos partidos y movimientos regionales, pero mucho más fuertes, representativos (…)”, de acuerdo a lo referido en la respectiva resolución formulada por el ROP.

En dicho pronunciamiento, también se declara improcedente la solicitud presentada por el ciudadano Henry Jarek Tello Godoy, el pasado 6 de setiembre de 2021, a través de la cual se pedía al ROP no iniciar procedimiento de cancelación de oficio en contra de esta agrupación.

De otro lado, el registro en mención también observó que cuatro organizaciones políticas no cumplían con la exigencia establecida en el artículo 13°, literal e) de la LOP, el cual refiere que se cancela la inscripción de una agrupación al no participar en una elección de alcance nacional o retirar todas las listas de candidatos del proceso electoral correspondiente.

Inmersos en esta causal se encuentran el Partido Aprista Peruano; Perú Nación; Todos por el Perú; y Vamos Perú, por lo cual el ROP emitió pronunciamiento al respecto en el sentido señalado.

De esta forma, mantienen su inscripción en el ROP nueve partidos políticos, siendo estos: Acción Popular; Alianza para el Progreso; Avanza País- Partido de Integración Social; Fuerza Popular; Juntos por el Perú; Somos Perú; Perú Libre; Podemos Perú; y Renovación Popular.

Cabe anotar que cualquiera de las organizaciones políticas que se encuentre en desacuerdo con las resoluciones del ROP puede utilizar las herramientas legales correspondientes.

In the case of the Purple Party, the ROP indicates that this group only meets one of the conditions indicated in the aforementioned law to maintain its registration, that is, in the EG-2021 it obtained a minimum of 5 percent of the valid votes at the level national. In this regard, it specifies that what was established in the LOP is categorical in terms of having the two requirements referred to above, for which it proceeded to cancel this organization.

It adds that the legislator, by modifying the aforementioned article of the regulation in reference, through Law 30995, sought to increase the requirements for a party to retain its registration, which is clear from its explanatory memorandum in which it states that in this way it is it will be able to “bring closer to a political system with fewer parties and regional movements, but much stronger, more representative (…)”, according to what is referred to in the respective resolution formulated by the ROP.

In said pronouncement, the request submitted by citizen Henry Jarek Tello Godoy, on September 6, 2021, was also declared inadmissible, through which the ROP was asked not to initiate ex officio cancellation proceedings against this group.

On the other hand, the aforementioned registry also observed that four political organizations did not comply with the requirement established in article 13, literal e) of the LOP, which refers that the registration of a group is canceled by not participating in an election of national scope or withdraw all the lists of candidates from the corresponding electoral process.

Immersed in this cause are the Peruvian Aprista Party; Peru Nation; All for Peru; and Vamos Perú, for which the Operating Regulations issued a statement in this regard in the aforementioned sense.

In this way, nine political parties maintain their registration in the ROP, these being: Popular Action; Alliance for Progress; Avanza País- Social Integration Party; Popular Force; Together for Peru; We are Peru; Free Peru; We can Peru; and Popular Renovation.

It should be noted that any of the political organizations that disagree with the ROP resolutions can use the corresponding legal tools.
