Gobierno aprobó la norma legal para el retorno en el país a la presencialidad y/o semipresencialidad del año escolar 2022.

La citada norma invoca el artículo 79 de la Ley N° 28044 la misma que establece que el Ministerio de Educación es el órgano del Gobierno Nacional que tiene por finalidad definir, dirigir, y articular la política de educación, recreación y deporte, en concordancia con la política general del Estado.

Así mismo que, mediante Resolución Ministerial N° 972-2020/MINSA, se aprobó el documento técnico denominado “Lineamientos para la vigilancia, prevención y control de la salud de los trabajadores con riesgo de exposición a SARS-CoV-2”, el cual tiene por finalidad contribuir con la disminución de riesgo de transmisión de la COVID-19 en el ámbito laboral, implementando lineamientos generales para la vigilancia, prevención y control de la salud de los trabajadores con riesgo de exposición.

Del mismo modo que, a través de la Resolución Ministerial N° 1218-2021/MINSA, se aprueba la “NTS N° 178-MINSA/DGIESP-2021, norma técnica de salud para la prevención y control de la COVID-19 en el Perú”, el cual tiene por objetivo establecer los criterios técnicos y procedimientos para la prevención y control de la COVID-19 en el Perú con el fin de contribuir a la reducción del impacto sanitario, social y económico de la COVID-19 en el territorio nacional, a través de acciones dirigidas a su prevención y control.

Y que mediante Resolución Ministerial Nº 368-2021-MINEDU, se aprobó el Plan Nacional de Emergencia del Sistema Educativo Peruano, el cual tiene por objetivo consolidar y lograr los aprendizajes de los estudiantes de la educación básica, superior y técnico-productiva potenciando la innovación y respuestas educativas en atención a la diversidad de los territorios del Perú, cerrando las brechas de inequidad y dando respuesta desde la educación a la emergencia sanitaria por el COVID -19.

Gobierno aprobó la norma legal para el retorno en el país a la presencialidad y/o semipresencialidad del año escolar 2022.

Que, el precitado Plan de Emergencia aborde seis (6) ejes:
1.- Recuperación y consolidación de aprendizajes de los estudiantes de la Educación Básica y retorno a la presencialidad.
2.- Desarrollo profesional docente.
3.- Innovación tecnológica y competitividad educativa.
4.- Educación Superior.
5.- Atención integral de las poblaciones rurales, indígenas, afroperuana y personas con discapacidad.
6.- Descentralización.

Y que a la fecha se tiene la opinión favorable de la Dirección General de Educación Básica Regular, la Dirección General de Educación Básica Alternativa, Intercultural Bilingüe y de Servicios Educativos en el Ámbito Rural, la Dirección General de Servicios Educativos Especializados, la Dirección General de Desarrollo Docente, la Dirección General de Calidad de la Gestión Escolar, la Dirección General de Gestión Descentralizada, la Dirección de Innovación Tecnológica en Educación y el Programa Nacional de Infraestructura Educativa.

Paralelamente la Unidad de Planificación y Presupuesto de la Oficina de Planificación Estratégica y Presupuesto, dependiente de la Secretaría de Planificación Estratégica, emitió opinión favorable, señalando que la propuesta se encuentra alineada con los objetivos estratégicos e institucionales del sector y, desde el punto de vista presupuestal, no irrogará gastos adicionales al Pliego 010: Ministerio de Educación.

El gobierno a través del Ministerio de Educación, resuelve, derogar la Resolución N° 121-2021-MINEDU, que aprobó el documento normativo denominado “Disposiciones para la prestación del servicio en las instituciones y programas educativos públicos y privados de la Educación Básica de los ámbitos urbanos y rurales, en el marco de la emergencia sanitaria de la Covid-19”, modificado por las Resoluciones Ministeriales N° 199-2021-MINEDU, N° 273-2021-MINEDU y N° 458-2021-MINEDU, así como las disposiciones que se opongan a lo dispuesto en el documento normativo aprobado por el artículo 2 de la presente resolución.

Seguidamente se aprueba el documento normativo denominado “Disposiciones para el retorno a la presencialidad y/o semipresencialidad, así como para la prestación del servicio educativo para el año escolar 2022 en instituciones y programas educativos de la Educación Básica, ubicadas en los ámbitos urbano y rural, en el marco de la emergencia sanitaria por la COVID-19” el mismo que, como anexo, forma parte integrante de la presente resolución.

Y finalmente se resuelva disponer la publicación de la presente resolución y su anexo en el Sistema de Información Jurídica de Educación (SIJE), ubicado en el portal institucional del Ministerio de Educación (www.gob.pe/minedu), el mismo día de la publicación (hoy sábado 25 de diciembre del año en curso) de la presente resolución en el diario oficial “El Peruano”. At the same time, the Planning and Budget Unit of the Office of Strategic Planning and Budget, dependent on the Secretariat of Strategic Planning, issued a favorable opinion, noting that the proposal is aligned with the strategic and institutional objectives of the sector and, from the point of view budgetary, will not incur additional expenses to Sheet 010: Ministry of Education.
