EL PRESIDENTE DE LA REPÚBLICA
CONSIDERANDO:
Que, el numeral 5 del artículo 118 de la Constitución Política del Perú establece que corresponde al Presidente de la República convocar a elecciones para alcaldes y regidores y demás funcionarios que señala la ley;
Que, el artículo 1 de la Ley Nº 26864, Ley de Elecciones Municipales, dispone que en las elecciones municipales se eligen Alcaldes y Regidores de los Concejos Municipales Provinciales y Distritales en toda la República; asimismo, se dispone que las elecciones municipales se realizan cada cuatro (4) años;
Que, el artículo 5 de Ley Nº 27683, Ley de Elecciones Regionales, establece que las autoridades regionales son electas para un periodo de cuatro (4) años;
Que, conforme al artículo 4 de la Ley Nº 27683, modificado por el artículo 3 de la Ley Nº 30673, “Ley que modifica la Ley 28094, Ley de Organizaciones Políticas; La Ley 26859, Ley Orgánica de Elecciones; La Ley 27683, Ley de Elecciones Regionales; y la Ley 26864, Ley de Elecciones Municipales; con la finalidad de Uniformizar el Cronograma Electoral”, las elecciones regionales se realizan junto con las elecciones municipales el primer domingo del mes de octubre del año en que finaliza el mandato de las autoridades regionales. Asimismo, se establece que el Presidente de la República convoca a elecciones regionales con una anticipación no menor de doscientos setenta (270) días calendario a la fecha del acto electoral;
Que, el artículo 3 de la Ley Nº 26864, modificado por el artículo 4 de la Ley Nº 30673, dispone que el Presidente de la República convoca a elecciones municipales con una anticipación no menor a doscientos setenta (270) días calendario a la fecha de las elecciones, las que se llevan a cabo el primer domingo del mes de octubre del año en que finaliza el mandato de las autoridades municipales;
Que, mediante el Oficio Nº 0753-2021-P/JNE, de fecha 29 de diciembre del 2021, el Presidente del Jurado Nacional de Elecciones remite a la Presidencia del Consejo de Ministros, el acuerdo del Pleno del Jurado Nacional de Elecciones, de fecha 22 de diciembre de 2021, que dispone solicitar al señor Presidente de la República la convocatoria a Elecciones Regionales 2022 de gobernadores, vicegobernadores y consejeros del consejo regional de los gobiernos regionales de los departamentos de toda la República y de la Provincia Constitucional del Callao; así como a Elecciones Municipales 2022 de alcaldes y regidores de los concejos provinciales y concejos distritales de la República; ambas elecciones para el primer domingo de octubre de 2022;
Que, en tal sentido, resulta necesario convocar a elecciones regionales y municipales 2022, para elegir a las autoridades regionales y municipales por voto popular para el primer domingo de octubre de 2022, esto es, el 2 de octubre de 2022;
De conformidad con lo dispuesto en el numeral 5 del artículo 118 de la Constitución Política del Perú; la Ley Nº 26864, Ley de Elecciones Municipales; la Ley Nº 27683, Ley de Elecciones Regionales; y, la Ley Nº 29158, Ley Orgánica del Poder Ejecutivo;
DECRETA:
Artículo 1.- Convocatoria a Elecciones Regionales
Convóquese a Elecciones Regionales 2022 de gobernadores, vicegobernadores y consejeros del consejo regional de los gobiernos regionales de los departamentos de toda la República y de la Provincia Constitucional del Callao, para el 2 de octubre de 2022.
Artículo 2.- Convocatoria a Elecciones Municipales
Convóquese a Elecciones Municipales 2022 de alcaldes y regidores de los concejos provinciales y concejos distritales de la República, para el 2 de octubre de 2022.
Artículo 3.- Normas de aplicación
Las Elecciones Regionales y Municipales se regirán por lo dispuesto en la Constitución Política del Perú; la Ley Nº 26864, Ley de Elecciones Municipales; y, la Ley Nº 27683, Ley de Elecciones Regionales.
Artículo 4.- Refrendo
El presente Decreto Supremo es refrendado por la Presidenta del Consejo de Ministros.

THE PRESIDENT OF THE REPUBLIC
CONSIDERING:
That, number 5 of article 118 of the Political Constitution of Peru establishes that it corresponds to the President of the Republic to call elections for mayors and councilors and other officials established by law;
That, Article 1 of Law No. 26864, Municipal Elections Law, provides that in municipal elections mayors and Councilors of Provincial and District Municipal Councils are elected throughout the Republic; likewise, it is provided that municipal elections are held every four (4) years;
That, Article 5 of Law No. 27683, Law of Regional Elections, establishes that regional authorities are elected for a period of four (4) years;
That, pursuant to Article 4 of Law No. 27683, modified by Article 3 of Law No. 30673, “Law that modifies Law 28094, Law of Political Organizations; Law 26859, Organic Law of Elections; Law 27683, Law of Regional Elections; and Law 26864, Municipal Elections Law; in order to standardize the Electoral Schedule ”, the regional elections are held together with the municipal elections on the first Sunday of October of the year in which the mandate of the regional authorities ends. Likewise, it is established that the President of the Republic calls regional elections no less than two hundred and seventy (270) calendar days before the date of the electoral act;
That, Article 3 of Law No. 26864, modified by Article 4 of Law No. 30673, provides that the President of the Republic calls municipal elections with no less than two hundred and seventy (270) calendar days prior to the date of elections, which are held on the first Sunday of October of the year in which the mandate of the municipal authorities ends;
That, by means of Official Letter No. 0753-2021-P / JNE, dated December 29, 2021, the President of the National Elections Jury forwards to the Presidency of the Council of Ministers, the agreement of the Plenary of the National Elections Jury, dated December 22, 2021, which provides to request the President of the Republic to call 2022 Regional Elections of governors, vice-governors and advisers of the regional council of the regional governments of the departments of the entire Republic and of the Constitutional Province of Callao; as well as Municipal Elections 2022 of mayors and councilors of the provincial councils and district councils of the Republic; both elections for the first Sunday of October 2022;
That, in this sense, it is necessary to call regional and municipal elections in 2022, to elect regional and municipal authorities by popular vote for the first Sunday in October 2022, that is, October 2, 2022;
In accordance with the provisions of paragraph 5 of article 118 of the Political Constitution of Peru; Law No. 26864, Municipal Elections Law; Law No. 27683, Law of Regional Elections; and, Law No. 29158, Organic Law of the Executive Power;
DECREE:
Article 1.- Call for Regional Elections
Call for Regional Elections 2022 of governors, deputy governors and advisers of the regional council of the regional governments of the departments of the entire Republic and of the Constitutional Province of Callao, for October 2, 2022.
Article 2.- Call for Municipal Elections
Call for Municipal Elections 2022 of mayors and councilors of the provincial councils and district councils of the Republic, for October 2, 2022.
Article 3.- Application rules
Regional and Municipal Elections will be governed by the provisions of the Political Constitution of Peru; Law No. 26864, Municipal Elections Law; and, Law No. 27683, Law of Regional Elections.
Article 4.- Endorsement
This Supreme Decree is endorsed by the President of the Council of Ministers.
