Se trata del gerente general de la referida empresa, Jaime Fernández-Cuesta Luca de Tena y los funcionarios Renzo Tejada Mackenzie, Gísela Posadas Jhong y José Reyes Ruiz.
El magistrado Romualdo Aguedo Aranda, a cargo del referido juzgado, estableció, en su resolución, necesaria la medida por peligro de fuga y eventual obstaculización de la referida investigación.
Asimismo, en consideración a que el delito de contaminación ambiental está penado con una pena privativa de la libertad no menor de cuatro años.
También basó su decisión en que la defensa legal de los investigados se allanó al pedido de impedimento de salida del país solicitado por la Fiscalía Especializada en Delitos de Materia Ambiental, en una audiencia previa.
Debe señalarse que el Ministerio Público fundamentó en su pretensión que los investigados no habrían cumplido adecuadamente con sus responsabilidades funcionales, lo que habría originado un derrame de petróleo crudo contaminando las aguas marítimas, el suelo y el subsuelo costero peruano.
Ante los elementos presentados, el juez señaló que se le atribuye, en una etapa preliminar de investigación, la calidad de autor al gerente Fernández Cuesta, y como cómplices a Tejada, Posadas y Reyes.
De ese modo, el juez Aguedo Aranda ordenó se oficie de manera inmediata a la Policía Judicial y a la Superintendencia Nacional de Migraciones para el cumplimiento, registro y conocimiento de su decisión a nivel nacional.
