LA NORMA FUE EXONERADO DE SEGUNDA VOTACIÓN
De acuerdo con las palabras del titular de la Comisión de Educación, Juventud y Deporte, Esdras Medina Minaya (RP), la presente iniciativa se sostiene en los PL 129, 337, 429, 432, 443, 444, 445, 446 y 653, esta última, desacumulada por su propio autor “para que se debata y apruebe el texto sustitutorio para beneficio de nuestros maestros”.

Medina Minaya informó que la propuesta solo contiene un artículo único, en donde se modifica el artículo 63 de la Ley de Reforma Magisterial; y dos disposiciones complementarias finales.

La primera disposición complementaria final trata sobre la implementación de la norma y la segunda se refiere a la reglamentación.
El parlamentario sostuvo que el dictamen no contraviene ninguna disposición legal.

También, hizo referencia a la sentencia 3052-2009, del Tribunal Constitucional, que, en su fundamento jurídico 24, define que la “doctrina reconoce que el derecho a la Compensación por Tiempo de Servicios tiene como su fundamento la justicia social”.

«Una justicia siempre basada en el derecho que tiene el trabajador para que sus energías gastadas -por el esfuerzo diario a favor del empleador- tengan una retribución específica proporcionada al tiempo que ha trabajado para otro», dijo.

DEBATE
El parlamentario Alex Paredes Gonzales (PL), autor del PL 653 y que la retiró para que la iniciativa legislativa continúe con su proceso aprobatorio, sostuvo que el artículo 63 de la ley 29944, Ley de Reforma Magisterial “dañó” al docente, tal como lo estableció el Tribunal Constitucional.

La legisladora Karol Paredes Fonseca (AP) manifestó que “no se puede seguir invisibilizando a los maestros, y hay que valorarlos en vida, y no cuando mueran”; mientras que Jorge Morante Figari (FP) saludó la iniciativa, y dijo que su bancada votaría «con alegría» por esta norma.

A su turno, la parlamentaria Silvia Monteza Facho (AP) solicitó que se incorpore -en un texto sustitutorio- que este beneficio se extienda a los docentes de los institutos superiores. La propuesta no fue admitida por el titular de Educación porque ese sector no se encuentra dentro de la carrera magisterial.

Por su parte, el congresista Carlos Anderson Ramírez (PP) recordó que lo más importante de la educación son los alumnos, y aprovechó la oportunidad para que los maestros se comprometan en elevar la calidad de esta, y entiendan la importancia de la meritocracia.

Intervinieron en el debate los congresistas Pasión Dávila Atanacio (PL), Flavio Cruz Mamani (PL), Edwin Martínez Talavera (AP), Francis Paredes Castro (PL), Paul Gutiérrez Ticona (PL), Lucinda Vásquez Vela (PL), Edgard Tello Montes (PL), Segundo Quiroz Barboza (PL), Germán Tacuri Valdivia (PL), Jorge Marticorena Mendoza (PL) y Alfredo Pariona Sinche (PL).

También, Hamlet Echeverría Rodríguez (PD), Luis Aragón Carreño (AP), Tania Ramírez García (FP), Hilda Portero López (AP), Elías varas Meléndez (PL), Eduardo Salhuana Cavides (APP), María Acuña Peralta (APP), Oscar Zea Choquechambi (PL), Rosío Torres Salinas (APP), Segundo Montalvo Cubas (PL) y Víctor Flores Ruíz (FP).

La Comisión de Economía, a la que también fue derivada esta iniciativa, informó que tiene al respecto un dictamen de inhibición.

The parliamentarian maintained that the opinion does not contravene any legal provision.

He also made reference to ruling 3052-2009, of the Constitutional Court, which, in its legal basis 24, defines that the “doctrine recognizes that the right to Compensation for Time of Service is based on social justice.”

“A justice always based on the right that the worker has so that his energies spent -for the daily effort in favor of the employer- have a specific remuneration proportionate to the time he has worked for another,” he said.

DEBATE
