Señaló que durante toda la pandemia han seguido activos en sus operaciones, por lo que es urgente que estas empresas sean controladas de manera integral, pagando impuestos y cumpliendo con condiciones adecuadas, que garanticen la seguridad a los usuarios, así como la transparencia y las políticas de juego responsables, tal como ha sucedido en Colombia, México, Argentina, y gran parte de los Estados Unidos y Europa.

En ese sentido, explicó que, el documento establece que el Mincetur sea la entidad responsable de otorgar las autorizaciones para el uso de plataformas tecnológicas en juegos y apuestas deportivas, así como en locales físicos, por lo que las empresas deberán estar inscritas en el Registro Único de Contribuyentes. Además, deberán contar con un representante legal en Perú y un dominio web con la terminación “.pe”, evitando así la fuga de capitales y previniendo el lavado de activos, comisión de fraudes, delitos informáticos y cualquier otro propósito ilícito.

El anteproyecto indica que la fiscalización de las plataformas tecnológicas se realizará por accesos físicos y/o lógicos, presenciales o remotos. La propuesta también prohíbe la participación en apuestas de juegos y deportivas a distancia de los menores de edad y personas con ludopatía. Además, las empresas que no cuenten con la autorización sectorial respectiva estarán prohibidas de suscribir contratos de publicidad o patrocinio. Respecto a las sanciones administrativas estas incluyen: amonestación, multa (de 1 a 500 UIT), cancelación de autorización y/o registro administrativo, inhabilitación hasta por 10 (diez) años e inhabilitación permanente.

“El anteproyecto del Mincetur propone un impuesto directo del 12% aplicado al Ingreso Neto (Net Win). Del mismo modo, considera un impuesto selectivo al consumo de 1% a las apuestas pagadas por el cliente. En ese sentido, se estima una recaudación anual de alrededor de S/ 160 millones, que no sólo podrán ser invertidos en la reactivación del turismo, sino también en obras de infraestructura pública, especialmente para promover el deporte”, señaló el ministro Roberto Sánchez.

Es importante mencionar que la propuesta indica que luego de ser promulgada, el Mincetur deberá emitir el reglamento en un plazo que no exceda los 90 días hábiles. Cabe señalar que, a partir de la fecha de entrada en vigencia de la norma, las empresas deberán cumplir con lo señalado en el dispositivo legal en un plazo de ciento 120 días calendario.
