Agencia Peruana de Noticias PRENSAPERU.PE https://prensaperu.pe Twitter: @prensaperupe Con la finalidad de beneficiar a millones de usuarios del servicio de telecomunicaciones, el Pleno del Congreso aprobó hoy la iniciativa que propone otorgar facultades al Organismo Supervisor de Inversión Privada en Telecomunicaciones (Osiptel) a fin de que pueda fijar las tarifas tope de reconexión de los servicios de telefonía fija, cable, celular e Internet.

Se trata del dictamen que modifica la Ley de desarrollo de las funciones y facultades del Osiptel, aprobado con 77 votos a favor, 31 en contra y 7 abstenciones. Enseguida fue exonerado del trámite de segunda votación con 78 votos a favor, 32 en contra y 6 abstenciones.

Fue el congresista José Luna Gálvez (NA), en su condición de presidente de la Comisión de Defensa del Consumidor y Organismos Reguladores de los Servicios Públicos, el encargado de sustentar el referido dictamen que fue elaborado en base al PL nro. 893, iniciativa de la congresista Lady Camones Soriano (APP).

Dijo que se busca dar solucionar a un problema que afecta a miles de peruanos que ven afectadas sus economías familiares con cobros excesivos en la reconexión del servicio de telefonía, cable e Internet.

”Se pretende solucionar un problema que es latente cuyas quejas han llegado a la Comisión de Defensa del Consumidor del Congreso porque no se sabe cuánto van a cobrar por reconexión de celular, teléfono fijo o cable, que puede ser 2 soles o 60 soles”, explicó.

Observó que los montos cobrados no reflejan su real costo. “Cobran 30 o 60 soles por machucar un botón para la reconexión. Eso no refleja el costo real y Osiptel tiene que fijar los costos reales”, anotó.

El presidente de la Comisión de Defensa del Consumidor hizo una precisión antes de consultar la exoneración del trámite de segunda votación a la Representación Nacional.

“Se ha puesto un candado que dice que la regulación o fijación de las tarifas tope se efectuarán en base a los costos en el marco de la Ley 27838, Ley de Transparencia y simplificación de los procedimientos regulatorios de las tarifas”, puntualizó.

La congresista Camones Soriano resaltó la necesidad de que Osiptel esté facultado para fijar topes tarifarios por concepto de reconexión del servicio, así como aquellas que se derivan de las normas de condiciones de uso.

Dijo que la medida permitirá una reducción significativa de los altos costos de reconexión existentes en los diferentes servicios y corregir la alta dispersión de tarifas de reconexión entre los actuales operadores de telecomunicaciones en nuestro país.

“Es una medida positiva para los usuarios del servicio de telecomunicaciones que ven afectadas sus economías familiares con cobros excesivos y abusivos”, dijo.

La parlamentaria observó que la ley vigente faculta al Osiptel a intervenir en la regulación de las tarifas de reconexión en el cobro de los recibos mensuales, pero no lo faculta en regular y fijar las tarifas de reconexión, por lo que advirtió un vacío legal.

Camones Soriano señaló que con la proyectada norma se beneficiarán más de 30 millones de peruanos usuarios de líneas celulares; así como a más de 20 millones de peruanos usuarios de servicios de Internet y telefonía fija en nuestro país.

It noted that the amounts charged do not reflect their real cost. “They charge 30 or 60 soles to hit a button for reconnection. That does not reflect the real cost and Osiptel has to set the real costs”, he noted.

The president of the Commission for the Defense of the Consumer made a precision before consulting the exoneration of the process of second vote to the National Representation.

“A padlock has been placed that says that the regulation or setting of the ceiling rates will be carried out based on the costs within the framework of Law 27838, Law of Transparency and simplification of the regulatory procedures of the rates”, he pointed out.

Congresswoman Camones Soriano highlighted the need for Osiptel to be empowered to set rate caps for service reconnection, as well as those derived from the rules of conditions of use.

He said that the measure will allow a significant reduction of the high reconnection costs existing in the different services and correct the high dispersion of reconnection rates among the current telecommunications operators in our country.

“It is a positive measure for users of the telecommunications service whose family finances are affected by excessive and abusive charges,” he said.

The parliamentarian observed that the current law empowers Osiptel to intervene in the regulation of reconnection rates in the collection of monthly bills, but does not empower it to regulate and set reconnection rates, for which she warned of a legal vacuum.

Camones Soriano pointed out that with the projected standard, more than 30 million Peruvian users of cell lines will benefit; as well as more than 20 million Peruvian users of Internet and fixed telephony services in our country.
