El artículo 201 de la Constitución Política del Perú dispone que “los miembros del TC son elegidos por el Congreso de la República con el voto favorable de los dos tercios del número legal de sus miembros”, es decir, con 87 votos.

Como se sabe, la Comisión Especial de Selección de Candidatas y Candidatos Aptos para la Elección de Magistrados del Tribunal Constitucional presentó su informe final y presentó la lista de 6 postulantes aptos, en base al cuadro de méritos alcanzado en el concurso público. Ellos son:

-Morales Saravia, Francisco Humberto
Orden de mérito: 1

-Gutiérrez Ticse, Luis Gustavo
Orden de mérito: 2

-Domínguez Haro, Helder
Orden de mérito: 3

-Pacheco Zerga, Luz Imelda
Orden de mérito: 4

-Monteagudo Valdez, Manuel
Orden de mérito: 5

-Ochoa Cardich, César Augusto
Orden de mérito: 6

«La designación para el cargo de magistrado del Tribunal se hace por cinco años. No hay reelección inmediata», señala el artículo 9 de la Ley Orgánica del Tribunal Constitucional.
