“La Zona Franca de Tumbes (ZOFRATUMBES) es el ámbito físico en el que las mercancías que se internen están exoneradas de los derechos e impuestos de importación; y, en el que las actividades industriales, agroindustriales, de maquila y de servicios diversos que se realicen están exoneradas del impuesto a la renta”, expresó ante sus colegas integrantes de dicha comisión.

En la misma línea, la legisladora Cordero Jon Tay, detalló que ZOFRATUMBES estará ubicado “en la provincia de Zarumilla, en el distrito de Aguas Verdes”, donde está situado el “Centro de Transformación Industrial y de Comercialización (CETICOS).”

Asimismo indicó que la Zona Comercial de Tumbes estaría ubicado en el mismo espacio geográfico de Tumbes. “Comprende los mercados, centros comerciales y similares, en los que las operaciones de venta de bienes para uso y consumo personal sin fines comerciales y/o empresariales están exoneradas del Impuesto General a las Ventas, del Impuesto Selectivo al Consumo y del Impuesto de Promoción Municipal, pagando únicamente un arancel especial, que sería determinado por el Reglamento correspondiente”, precisó.

A fin de promover la actividad turística se propone también “la inafectación del IGV a los servicios de hospedaje, cuando éstos sean prestados a personas extranjeras.”

De otro lado, la propuesta legislativa plantea que la administración de ZOFRATUMBES y la Zona Comercial este bajo un comité representado por un integrante del Gobierno Regional de Tumbes, Ministerio de Económica, Ministerio de Producción, Ministerio de Comercio Exterior, Adunas de Tumbes, Municipalidad Provincial de Zarumilla; de los distritos de Zarumilla, Aguas Verdes, Papayal y Matapalo; Cámara de Comercio y Producción de Tumbes, Colegio de Ingenieros de Tumbes y la Sociedad Nacional de Industria.

De esta manera, terminó la sustentación de ley la congresista María Cordero Jon Tay. Ahora corresponde que la Comisión de Comercio Exterior del Parlamento solicite la opinión a los diferentes organismos involucrados a fin de evaluar y debatir la propuesta legislativa.

Along the same lines, legislator Cordero Jon Tay explained that ZOFRATUMBES will be located “in the province of Zarumilla, in the district of Aguas Verdes”, where the “Center for Industrial Transformation and Marketing (CETICOS)” is located.

He also indicated that the Commercial Zone of Tumbes would be located in the same geographical area as Tumbes. “Includes markets, shopping centers and the like, in which the operations of selling goods for personal use and consumption without commercial and/or business purposes are exempt from the General Sales Tax, the Selective Consumption Tax and the Promotion Tax. Municipal, paying only a special fee, which would be determined by the corresponding Regulation”, he specified.

In order to promote tourist activity, it is also proposed “the unaffectation of the IGV to lodging services, when these are provided to foreigners.”

On the other hand, the legislative proposal proposes that the administration of ZOFRATUMBES and the Commercial Zone be under a committee represented by a member of the Regional Government of Tumbes, Ministry of Economics, Ministry of Production, Ministry of Foreign Trade, Customs of Tumbes, Provincial Municipality of Zarumilla; from the districts of Zarumilla, Aguas Verdes, Papayal and Matapalo; Chamber of Commerce and Production of Tumbes, College of Engineers of Tumbes and the National Society of Industry.

In this way, Congresswoman María Cordero Jon Tay ended the support of the law. Now it is up to the Parliament’s Foreign Trade Commission to request the opinion of the different bodies involved in order to evaluate and debate the legislative proposal.
