Son más de 5000 metros cuadrados recuperados (2074 metros en el primer piso y 3041 metros en el sótano), que forman parte del derecho de dominio del Poder Judicial inscrito en la Partida Registral N° 11348660 del Registro de Propiedad Inmueble de Lima (Sunarp), desde el 25 de marzo de 2002.
El Poder Judicial afronta actualmente un déficit de infraestructura propia, pues el 70 % de sus locales a nivel nacional son alquilados y generan un enorme gasto a la institución judicial.
Por ello, la necesidad imperiosa de contar con ambientes propios para brindar un servicio de justicia en mejores condiciones para los usuarios.
Cabe agregar que el AGN merece contar con infraestructura y ambientes óptimos para preservar, en las mejores condiciones, los documentos que salvaguardan la memoria histórica del país.
Para tratar este tema, la presidenta del Poder Judicial, Elvia Barrios, recibirá al ministro de Cultura, Alejandro Salas, el próximo 2 de junio a las 8:00 horas.
PROCESO
Luego de haber realizado y agotado las etapas previas a un proceso judicial en esta materia, la Procuraduría del Poder Judicial interpuso el 6 de octubre de 2014, la demanda de reivindicación para que se le restituya el área, la cual fue tramitada en el 29 Juzgado Civil de Lima.
Este juzgado declaró fundada la demanda y emitió sentencia de primera instancia el 29 de enero de 2018, y ordenó que el AGN restituya las áreas que ocupan en el Palacio de Justicia. En segunda instancia, la Segunda Sala Especializada en lo Civil de Lima, el 27 de agosto de 2018, confirmó la sentencia.
La Sala Civil Permanente de la Corte Suprema, en agosto del 2019, declaró improcedente un recurso de casación interpuesto por el Ministerio de Cultura en representación del Archivo General de la Nación (AGN) y, por ende, restituyó al Poder Judicial el área ocupada.
En cumplimiento de esta sentencia, el 29 Juzgado Civil de Lima, el 19 de mayo de 2022, dispuso el cumplimiento del fallo de la Corte Suprema, con lo cual quedó expedita la ejecución de la restitución de los ambientes ocupados por el AGN en el primer piso y sótano del Palacio de Justicia.

After years of litigation, the Judiciary recovers rooms of the National Palace of Justice that were occupied by the General Archive of the Nation.

PROCESS
After having carried out and exhausted the stages prior to a judicial process in this matter, the Attorney General’s Office of the Judicial Power filed on October 6, 2014, the claim for the restitution of the area, which was processed in the 29th Court. Civil of Lima.
This court declared the lawsuit well founded and issued a first instance judgment on January 29, 2018, and ordered the AGN to restore the areas they occupy in the Palace of Justice. In the second instance, the Second Specialized Civil Chamber of Lima, on August 27, 2018, confirmed the sentence.
The Permanent Civil Chamber of the Supreme Court, in August 2019, declared inadmissible an appeal filed by the Ministry of Culture on behalf of the General Archive of the Nation (AGN) and, therefore, returned the occupied area to the Judiciary.
In compliance with this ruling, the 29th Civil Court of Lima, on May 19, 2022, ordered compliance with the Supreme Court ruling, which expedited the execution of the restitution of the environments occupied by the AGN in the first floor and basement of the Palace of Justice.
