Al respecto, el jefe de Estado enfatizó que su gestión también trabaja para cautelar los derechos de los consumidores con el propósito de mejorar las condiciones de vida de las familias peruanas.
“Cómo gobierno siempre vamos a cautelar la defensa del consumidor. Hoy promulgamos esta importante ley para evitar que continúen los cobros excesivos a miles de usuarios. Como Ejecutivo seguiremos apoyando iniciativas legislativas que protejan los intereses de todos los peruanos”, destacó el mandatario.
La norma publicada hoy en el Diario Oficial El Peruano, que favorecerá a más de 30 millones de usuarios, incorpora el artículo 39 en la Ley N° 27336, Ley de Desarrollo de las Funciones y Facultades del Osiptel, para facultarla a establecer estos topes tarifarios.
“El Organismo Supervisor de la Inversión Privada en Telecomunicaciones (Osiptel) fija los topes tarifarios en aquellas tarifas establecidas por las entidades supervisadas por concepto de reconexión del servicio y en aquellas que se deriven de las normas de condiciones de uso”, señala en su único artículo.
COBRO ACTUAL POR SERVICIO
Actualmente, los usuarios de estos servicios se sujetan a tarifas por reconexión establecidas por los operadores y que no están fijadas al momento de la contratación del servicio.
El cobro por la reconexión oscila entre los 10 a 20 soles por cada servicio, pudiendo alcanzar los 30 soles para servicios empaquetados. En el caso de la televisión de paga, la reconexión tiene un rango de 5 a 60 soles.
Entre los argumentos de la ley se indica que, con el uso de nuevas tecnologías, el gasto de la reconexión dentro del servicio podría ser menor, por lo que, cobrar una tarifa superior al costo real significaría un perjuicio a los usuarios, señala el dictamen.
Asimismo, menciona que la misma problemática se produce en los trámites comprendidos para el uso de los servicios de telecomunicaciones, como las solicitudes de traslado, registro de llamadas entrantes, cambio de número a solicitud del abonado, cambio de titularidad, entre otros.
Cabe señalar que Osiptel deberá ajustar su reglamento en base a lo aprobado en la presente ley, estableciendo el régimen de infracciones que sanciona el incumplimiento de lo estipulado.

“As a government we are always going to protect consumer protection. Today we enact this important law to prevent excessive charges to thousands of users from continuing. As an Executive, we will continue to support legislative initiatives that protect the interests of all Peruvians,” said the president.
The rule published today in the Official Gazette El Peruano, which will favor more than 30 million users, incorporates article 39 in Law No. 27336, Law for the Development of the Functions and Powers of Osiptel, to empower it to establish these rate caps .
“The Supervisory Body for Private Investment in Telecommunications (Osiptel) sets the rate caps on those rates established by the supervised entities for the reconnection of the service and on those derived from the rules of conditions of use,” it states in its sole Article.
CURRENT SERVICE CHARGE
Currently, users of these services are subject to reconnection fees established by the operators and that are not set at the time of contracting the service.
The charge for reconnection ranges between 10 to 20 soles for each service, and can reach 30 soles for packaged services. In the case of pay television, the reconnection has a range of 5 to 60 soles.
Among the arguments of the law it is indicated that, with the use of new technologies, the cost of reconnection within the service could be lower, therefore, charging a rate higher than the real cost would mean harm to users, says the opinion .
Likewise, it mentions that the same problem occurs in the procedures included for the use of telecommunications services, such as transfer requests, registration of incoming calls, change of number at the request of the subscriber, change of ownership, among others.
It should be noted that Osiptel must adjust its regulations based on what is approved in this law, establishing the system of infractions that sanctions non-compliance with the provisions.
