Asimismo, indicó que la aplicación de este modelo de justicia célere, será un elemento disuasivo para los criminales.

Así lo sostuvo en una entrevista al programa Hablemos Claro de radio Exitosa en la cual también explicó los beneficios que obtendrá la institución que preside con la aplicación del proceso inmediato en casos de flagrancia con la puesta en funcionamiento de la Unidad de Flagrancia este 1 de julio, en Trujillo.

Explicó que de acuerdo con la información de la Unidad del Equipo Técnico Institucional del Código Procesal Penal (UETI-CPP) del Poder Judicial, los procesos inmediatos se tramitan en un período de once meses, esto es, en un promedio de 20 sesiones, con un costo aproximado de S/12 000.

“Aplicando el proceso inmediato, a partir de julio, este se podría realizar en tres sesiones de audiencia y el costo para nuestra institución no llegaría ni a S/1600”, precisó.

Detalló que una sesión de audiencia -de una hora- le cuesta al Poder Judicial S/525, monto que cubre los costos de remuneraciones de trabajadores, alquiler de local, depreciación de computadoras, uso de papel, entre otros.

Otro de los beneficios es que contribuye a la descarga procesal. “Los jueces tendrán más tiempo para conocer otros procesos más complejos”, indicó.

INTERVENCIONES
Advirtió que el año pasado, la Policía Nacional realizó aproximadamente 150 mil intervenciones policiales, y en la mayoría de los casos fueron actos cometidos en flagrancia. “Esto equivale a decir que esas personas fueron detenidas cometiendo el evento delictuoso”, acotó.

Indicó que esta cifra no se ve reflejada en las estadísticas del Poder Judicial, pues estas intervenciones no fueron incoadas (iniciadas) como proceso inmediato por el Ministerio Público, sino que se les está dando un procedimiento diferente, esto es, como procesos comunes.

Sostuvo que la Unidad de Flagrancia otorga otra ventaja es que el Ministerio Público, formulará su acusación en un máximo de 72 horas, y que los jueces y juezas podrán sentenciar también en un plazo de dos a tres días.

FORTALECER LA JUSTICIA
Por otro lado, respecto al nombramiento de los seis jueces supremos titulares por parte de la Junta Nacional de Justicia, Barrios Alvarado expresó que estos nombramientos van a fortalecer el sistema de justicia.

“La Corte Suprema va a estar integrada por jueces y juezas titulares, antes estaba conformada por 20 magistrados/as; a la fecha hay varios que se han jubilado y otros han sido separados del cargo. Ahora las salas supremas podrán ser presididas por jueces titulares y no por provisionales como venía ocurriendo”, expresó.

He explained that a one-hour hearing session costs the Judiciary S/525, an amount that covers the costs of workers’ compensation, rental of premises, depreciation of computers, use of paper, among others.

Another benefit is that it contributes to procedural discharge. “The judges will have more time to learn about other more complex processes,” he said.

INTERVENTIONS
He warned that last year, the National Police carried out approximately 150,000 police interventions, and in most cases they were acts committed in flagrante delicto. “This is equivalent to saying that these people were arrested committing the criminal event,” he said.

He indicated that this figure is not reflected in the statistics of the Judiciary, since these interventions were not initiated (initiated) as an immediate process by the Public Ministry, but rather they are being given a different procedure, that is, as common processes.

He argued that the Flagrancia Unit grants another advantage is that the Public Ministry will formulate its accusation in a maximum of 72 hours, and that the judges will also be able to sentence within a period of two to three days.

STRENGTHEN JUSTICE
On the other hand, regarding the appointment of the six titular supreme judges by the National Justice Board, Barrios Alvarado stated that these appointments will strengthen the justice system.

“The Supreme Court is going to be made up of regular judges, before it was made up of 20 magistrates; to date there are several who have retired and others have been removed from office. Now the supreme chambers may be chaired by permanent judges and not by provisional judges, as has been the case,” he said.
