El titular de la cartera ministerial de Comercio Exterior y Turismo, en declaraciones a Prensaperú.pe expresó prístinamente que ahora el predictamen del Proyecto de Ley 2070/2021-PE pasará al Pleno del Congreso de la República, para su respectiva aprobación, detalló.

Como se sabe para ello, el ministro Sánchez y un equipo técnico de Mincetur se presentó ante la mencionada comisión del parlamento peruano, donde absolvió ante los legisladores una serie de consultas relacionadas al tema y afirmó que la propuesta del Ejecutivo va de la mano de modelos exitosos a nivel internacional, alentando las inversiones en el marco de las políticas de juego responsable.
“Los juegos y apuestas deportivas a distancia deben ser regulados de manera eficaz al haberse generado, en el último año, un movimiento económico de alrededor de US$ 1 000 millones, sin rendir ingresos al erario nacional. La propuesta presentada por el Ejecutivo revela que se podría recaudar S/ 160 millones anuales a ser invertidos en la reactivación del turismo, además en obras de infraestructura pública y promover el deporte”, sostuvo el ministro Sánchez Palomino.
De otro lado indicó, también, que la propuesta del Ejecutivo tiene la opinión favorable de todos los ministerios, entre ellos, de Economía y Finanzas, y el de Salud. Además, se compartió con entidades de salud mental, donde se concluyó que esta actividad debe regularse de manera integral.
El Proyecto de Ley del Ejecutivo señala que el Mincetur es la entidad responsable para otorgar las autorizaciones para el uso de plataformas tecnológicas en juegos y apuestas deportivas, así como en locales físicos, por lo que las empresas deberán estar inscritas en el Registro Único de Contribuyentes.
Del mismo modo, se establece la constitución de garantías a favor del Estado para cubrir el pago de multas y premios, además, se plantea un impuesto directo aplicado al Ingreso Neto (Net Win) del 12% (mismo porcentaje que la actividad de casino y máquinas tragamonedas), entre otros.
La propuesta refiere que la fiscalización de las plataformas tecnológicas se realizará por accesos físicos y/o lógicos, presenciales o remotos. Además, se prohíbe la participación en los juegos y apuestas deportivas a distancia de los menores de edad y personas con ludopatía, identificadas a través del Registro de Personas Prohibidas a Acceder a Juegos de Casinos y Máquinas Tragamonedas.
Del mismo modo, el proyecto establece que del 100% recaudado por concepto del Impuesto a los Juegos, el 40% de la recaudación se dirigirá al tesoro público, el 20% restante va al Instituto Peruano del Deporte (IPD) y el 40% al Mincetur.
“Es trascendental que este tipo de juegos se lleven a cabo con integridad, honestidad, transparencia y trato igualitario, protegiendo a los grupos vulnerables y evitando que la actividad sea empleada para actos de delitos informáticos, fraudes y otros ilícitos”, finalizó el titular de la cartera ministerial de Comercio Exterior y Turismo, Roberto Sánchez Palomino.

In the same way, the constitution of guarantees in favor of the State is established to cover the payment of fines and prizes, in addition, a direct tax applied to the Net Income (Net Win) of 12% (same percentage as the casino activity and slot machines), among others.
The proposal states that the control of the technological platforms will be carried out by physical and/or logical, face-to-face or remote access. In addition, the participation in remote sports games and betting of minors and people with gambling problems, identified through the Registry of Persons Prohibited from Accessing Casino Games and Slot Machines, is prohibited.
