Congreso aprueba Ley para que personal CAS de EsSalud pase al régimen laboral de D.L 728, beneficiando a más de cinco mil trabajadores.

La decisión se adoptó por 110 votos a favor, cero en contra y una abstención. La propuesta, que beneficiará a más de cinco mil trabajadores CAS, fue exonerada de segunda votación con 111 votos a favor, cero en contra y tres abstenciones, con lo que quedó expedita para ser enviada al Poder Ejecutivo para su eventual promulgación.

El objeto del dictamen de los proyectos de ley 2307, 2509 y otros, es incorporar al personal profesional, no profesional, asistencial y administrativo, que se encuentra laborando en EsSalud, bajo el régimen CAS a plazo indeterminado, al régimen laboral del D.L. 728, de manera gradual y progresiva de acuerdo a la disponibilidad presupuestal y en el orden de prelación del tiempo de servicio en el plazo de tres años.

Entre los requisitos para esa incorporación está haber ingresado a la institución mediante proceso de selección por concurso público de méritos, a la fecha de promulgación de la presente Ley, y encontrarse laborando bajo la modalidad CAS a plazo indeterminado.

Además, el Seguro Social de Salud tiene un plazo no mayor de tres (3) años, contados a partir de la vigencia de la presente ley, para incorporar de manera progresiva bajo el Régimen Laboral del Decreto Legislativo 728, con contrato a plazo indeterminado o indefinido y que cumplan con los requisitos señalados.

La propuesta señala que el responsable de la implementación del proceso es el titular de la entidad quien designa mediante acto resolutivo a los miembros de la comisión de incorporación, debiendo presidir la misma el responsable de la Oficina de Recursos Humanos o la oficina que haga sus veces de cada red asistencial. Las funciones de la comisión serán establecidas en el reglamento de la presente ley.

La reglamentación y demás normas complementarias para la adecuada implementación de la presente ley es elaborada por el Ministerio de Trabajo y Promoción del Empleo (MTPE), en coordinación con el Seguro Social de Salud (EsSalud), en el plazo máximo de 90 días calendario siguientes a la promulgación de la presente ley. Vencido el plazo, EsSalud tiene un plazo de 120 días calendario para iniciar las acciones necesarias para las incorporaciones, conforme a lo dispuesto en la presente ley.

Sustentó la propuesta, el congresista José Luna Gálvez (PP), presidente de la Comisión de Presupuesto y Cuenta General de la República, quien dijo esta beneficia al personal del Decreto Legislativo 728, es decir, al personal profesional de la salud, profesional técnico y auxiliar asistencial, y administrativo que se encuentran en EsSalud, bajo el régimen de Contrato Administrativo de Servicios (CAS) a plazo indeterminado.

«Esta incorporación será de manera gradual y progresiva de acuerdo a la disponibilidad presupuestal», precisó.

En tanto, la legisladora Elva Julón Irigoin (APP), presidenta de la Comisión de Salud y Población, indicó que su comisión se adhirió a la propuesta de la Comisión de Presupuesto porque, según dijo, coincide con el texto.

«Atendiendo dichas razones, les pido el apoyo de este Pleno expresándole a través su voto ya que profesionales vienen varios meses solicitando la aprobación», dijo.

A su vez, la legisladora Sigrid Bazán Narro (CD-JP) dijo que su propuesta tiene por objeto mantener el principio de igualdad en el ámbito laboral.

«En ese sentido, los requisitos para poder pasar de un régimen a otro sería estar trabajando de forma continua por más de dos años al 31 de diciembre del 2022 y, en segundo lugar, haber ingresado la institución mediante concurso y la evaluación correspondiente en esa línea», sostuvo.

Por su parte, la congresista Isabel Cortez Aguirre (CD-JP) indicó que el régimen especial CAS inicialmente era una modalidad especial de contratación laboral temporal que entró en vigor en el año 2008 para solucionar la problemática generada por la proliferación de los servicios de personal en el sector público, pero que es un contrato desventajoso y discriminador en los derechos laborales sin beneficios.

En tanto, el legislador Juan Morí Celis (AP) señaló que su propuesta es para el personal de EsSalud que hace la misma función, pero que no tienen beneficios laborales.

«No reciben CTS, no tienen beneficios laborales y perciben su sueldo por debajo del sueldo mínimo. Considero que se debe reconocer el trabajo de este personal que estuvieron frente a la pandemia y sólo pido justicia y equidad», señaló.

El congresista Guido Bellido Ugarte (PL), dijo que el proyecto beneficiará a los trabajadores que han sido excluidos de cualquier beneficio laboral.

Su colega Alex Paredes Gonzales (BM) manifestó que hay una discriminación salarial y que con este proyecto encontrarán el resarcimiento de sus beneficiarios salariales.

El legislador Waldemar Cerrón Rojas (PL) señaló que la propuesta reconoce el trabajo del personal que estuvo atendiendo durante la pandemia de la COVID-19. Mientras que Enrique Wong Pujada (NoA) indicó que este Congreso trabaja en favor de los pueblos, y que esta iniciativa hace justicia a aquellos que estuvieron en la primera línea contra la pandemia.

The proposal indicates that the person responsible for the implementation of the process is the head of the entity, who designates the members of the incorporation commission by means of a resolution act, and the person in charge of the Human Resources Office or the office that acts as its chair must preside over it. of each healthcare network. The functions of the commission will be established in the regulations of this law.

The regulations and other complementary norms for the proper implementation of this law are prepared by the Ministry of Labor and Employment Promotion (MTPE), in coordination with the Social Security of Health (EsSalud), within a maximum period of 90 calendar days following to the promulgation of this law. Once the term expires, EsSalud has a term of 120 calendar days to initiate the necessary actions for the incorporations, in accordance with the provisions of this law.
