MOCIÓN DE ORDEN DEL DÍA N°
Los Congresistas de la República que suscriben de conformidad con el artículo 113.2 de la Constitución Política y lo previsto en el artículo 89-A del Reglamento del Congreso, presentamos la siguiente Moción de Orden del Día mediante el cual proponemos la VACANCIA DE LA PRESIDENCIA DE LA REPÚBLICA, ocupada a la fecha por la señora DINA ERCILA BOLUARTE ZEGARRA, por haber incurrido en la causal de PERMANENTE INCAPACIDAD MORAL, en atención a los siguientes fundamentos fácticos y de orden legal.
FUNDAMENTOS DE HECHO DE LA PROPUESTA DE VACANCIA PRESIDENCIAL.
Que, como es de conocimiento público nacional e internacional, dese el 07 de diciembre del año 2022 se han registrado manifestaciones en diversas regiones del país, reclamando una diversidad de pedidos, desde la renuncia inmediata de la señora Dina Ercila Boluarte Zegarra al cargo de Presidenta de la República, adelanto de elecciones generales, cambio constitucional mediante el mecanismo de la asamblea constituyente y la liberación del profesor José Pedro Castillo Terrones, quien a la fecha se encuentra recluido en las instalaciones del Centro Penitenciario Barbadillo (DINOES) en Ate Votarte.
Que, las protestas se han venido desarrollando en ciudades como Andahuaylas, cusco, Cajamarca, Arequipa, Puno, Ayacucho, San Martín, Huancayo, Ica, Huancavelica, Apurimac, Trujillo, Ucayali, Moquegua, Tacna, Loreto, Lima, Lima Provincias y Piura.
Que, a raíz de las modificaciones con fecha 12 de diciembre de 2022, mediante Decreto Supremo N° 139-2022-PCM, se declaró por el término de sesenta días calendario el Estado de Emergencia en las provincias de Abancay, Andahuaylas, Chincheros, Graü, Cotabambas, Antabamba y Aymaraes, del departamento de Apurímac.
Que, nuestro país está siendo desangrado por el pésimo manejo gubernamental y de las fuerzas de orden que lidera la señora Boluarte Zegarra, puesto que hasta la fecha ya van 44 personas fallecidas como consecuencia del uso desmedido de las ramas contra el pueblo peruano, es así que el Congreso de la República como primer Poder del Estado, tiene que ponerse a la altura de las circunstancias, a la defensa de la democracia, del Estado de Derecho, pero principalmente a la defensa de la vida de nuestra población, a la defensa de su integridad personal, y disponer sancionar a los principales culpables, como es el caso de la Presidenta del Perú, quien a ojos del mundo, ha demostrado no tener ningún ápice de sensibilidad humana con los pueblos de nuestro país.
Por todo lo expuesto,
EL CONGRESO DE LA REPÚBLICA ACUERDA:
Artículo 1. Declaración de permanente incapacidad moral de la Presidenta de la República.
Declárase la permanente incapacidad moral de la Presidenta de la República señora DINA ERCILA BOLUARTE ZEGARRA, según lo previsto en el artículo 113.2 de nuestra Constitución Política del Perú.
Artículo 2. Declaración de vacancia de la Presidencia de la República.
Declárase la vacancia de la Presidencia de la República, y, en consecuencia, la aplicación del artículo 115 de la Constitución Política del Perú que regula la sucesión presidencial.

The Congressmen of the Republic who sign in accordance with article 113.2 of the Political Constitution and the provisions of article 89-A of the Regulations of Congress, present the following Motion for the Agenda by which we propose the VACANCY OF THE PRESIDENCY OF THE REPUBLIC, occupied to date by Mrs. DINA ERCILA BOLUARTE ZEGARRA, for having incurred in the cause of PERMANENT MORAL DISABILITY, in response to the following factual and legal grounds.
FACTUAL BASIS OF THE PRESIDENTIAL VACANCY PROPOSAL.
That, as is national and international public knowledge, since December 7, 2022, there have been demonstrations in various regions of the country, demanding a variety of requests, since the immediate resignation of Mrs. Dina Ercila Boluarte Zegarra from the position of President of the Republic, early general elections, constitutional change through the constituent assembly mechanism and the release of Professor José Pedro Castillo Terrones, who to date is being held at the facilities of the Barbadillo Penitentiary Center (DINOES) in Ate Votarte.
That the protests have been taking place in cities such as Andahuaylas, Cusco, Cajamarca, Arequipa, Puno, Ayacucho, San Martín, Huancayo, Ica, Huancavelica, Apurimac, Trujillo, Ucayali, Moquegua, Tacna, Loreto, Lima, Lima Provinces and Piura .

That our country is being bled dry by the lousy government management and law enforcement led by Mrs. Boluarte Zegarra, since to date 44 people have died as a result of the excessive use of branches against the Peruvian people, it is so that the Congress of the Republic as the first Power of the State, has to rise to the occasion, to defend democracy, the rule of law, but mainly to defend the life of our population, to defend their personal integrity, and order to punish the main culprits, as is the case of the President of Peru, who in the eyes of the world, has shown not to have any iota of human sensitivity towards the peoples of our country.

THE CONGRESS OF THE REPUBLIC AGREES:
Article 1. Declaration of permanent moral incapacity of the President of the Republic.
The permanent moral incapacity of the President of the Republic Mrs. DINA ERCILA BOLUARTE ZEGARRA is declared, as provided in article 113.2 of our Political Constitution of Peru.
Article 2. Declaration of vacancy of the Presidency of the Republic.
The vacancy of the Presidency of the Republic is declared, and, consequently, the application of article 115 of the Political Constitution of Peru that regulates the presidential succession.
