Según so dossier resolutivo del Poder Ejecutivo, que invoca de acuerdo con lo dispuesto en el numeral 1) del artículo 137 de la Constitución Política del Perú; la Ley Nº 29158, Ley Orgánica del Poder Ejecutivo; la Ley Nº 29664, Ley que crea el Sistema Nacional de Gestión del Riesgo de Desastres (SINAGERD); el Reglamento de la Ley Nº 29664, que crea el Sistema Nacional de Gestión del Riesgo de Desastres (SINAGERD), aprobado mediante el Decreto Supremo Nº 048-2011-PCM; y, la “Norma Complementaria sobre la Declaratoria de Estado de Emergencia por Desastre o Peligro Inminente, en el marco de la Ley Nº 29664, del Sistema Nacional de Gestión de Riesgo de Desastres – SINAGERD”, aprobada por el Decreto Supremo Nº 074-2014-PCM; Con el voto aprobatorio del Consejo de Ministros, y con cargo a dar cuenta al Congreso de la República:

DECRETA:
Artículo 1.- Declaratoria del Estado de Emergencia
Declarar el Estado de Emergencia en el distrito de Mariano Nicolás Valcárcel de la provincia de Camaná del departamento de Arequipa, por impacto de daños ante intensas precipitaciones pluviales, por el plazo de sesenta (60) días calendario, para la ejecución de medidas y acciones de excepción, inmediatas y necesarias, de respuesta y rehabilitación que correspondan.

Artículo 2.- Acciones a ejecutar
El Gobierno Regional de Arequipa y los gobiernos locales comprendidos, con la coordinación técnica y seguimiento del Instituto Nacional de Defensa Civil (INDECI) y la participación del Ministerio de Salud, del Ministerio de Vivienda, Construcción y Saneamiento, del Ministerio de Transportes y Comunicaciones, del Ministerio del Interior, del Ministerio de Defensa, del Ministerio de Energía y Minas, del Ministerio de la Mujer y Poblaciones Vulnerables, del Ministerio de Desarrollo e Inclusión Social y demás instituciones públicas y privadas involucradas; ejecutarán las medidas y acciones de excepción, inmediatas y necesarias, de respuesta y rehabilitación de las zonas afectadas. Dichas acciones deberán tener nexo directo de causalidad entre las intervenciones y el evento, y podrán ser modificadas de acuerdo a las necesidades y elementos de seguridad que se vayan presentando durante su ejecución, sustentadas en los estudios técnicos de las entidades competentes.

Artículo 3.- Financiamiento
La implementación de las acciones previstas en el presente decreto supremo, se financia con cargo al presupuesto institucional de los pliegos involucrados, sin demandar recursos adicionales al Tesoro Público.

Artículo 4.- Refrendo
El presente decreto supremo es refrendado por el Presidente del Consejo de Ministros, la Ministra de Salud, la Ministra de Vivienda, Construcción y Saneamiento, la Ministra de Transportes y Comunicaciones, el Ministro del Interior, el Ministro de Defensa, el Ministro de Energía y Minas, la Ministra de la Mujer y Poblaciones Vulnerables y el Ministro de Desarrollo e Inclusión Social.

DECREES:
Article 1.- Declaration of the State of Emergency
Declare the State of Emergency in the district of Mariano Nicolás Valcárcel in the province of Camaná in the department of Arequipa, due to the impact of damage due to intense rainfall, for a period of sixty (60) calendar days, for the execution of measures and actions of exception, immediate and necessary, of response and rehabilitation that correspond.

Article 2.- Actions to be executed
The Regional Government of Arequipa and the local governments included, with the technical coordination and monitoring of the National Institute of Civil Defense (INDECI) and the participation of the Ministry of Health, the Ministry of Housing, Construction and Sanitation, the Ministry of Transport and Communications, the Ministry of the Interior, the Ministry of Defense, the Ministry of Energy and Mines, the Ministry of Women and Vulnerable Populations, the Ministry of Development and Social Inclusion and other public and private institutions involved; They will execute the emergency, immediate and necessary measures and actions for the response and rehabilitation of the affected areas. Article 3.- Financing
The implementation of the actions provided for in this supreme decree is financed from the institutional budget of the specifications involved, without requiring additional resources from the Public Treasury.

Article 4.- Endorsement
This supreme decree is endorsed by the President of the Council of Ministers, the Minister of Health, the Minister of Housing, Construction and Sanitation, the Minister of Transport and Communications, the Minister of the Interior, the Minister of Defense, the Minister of Energy and Mines, the Minister for Women and Vulnerable Populations and the Minister for Development and Social Inclusion.
