Agencia Peruana de Noticias PRENSAPERU.PE https://prensaperu.pe Twitter: @prensaperupe El Juzgado Civil del distrito de Santiago (Cusco), a cargo del magistrado Rafael Enrique Sierra Casanova, dispuso el cambio de nombre de una persona transgénero, en un proceso desarrollado bajo el sistema de la oralidad y resuelto en una sola audiencia.
Luego de revisar la pretensión principal, y en base a los estándares fijados por la Corte Interamericana de Derechos Humanos, y el antecedente de una sentencia emitida por el Tribunal Constitucional, el órgano jurisdiccional notificó a la Municipalidad Distrital de Santiago y al Registro Nacional de Identificación y Estado Civil (Reniec) para que modifique el nombre asignado de masculino a femenino.
Cabe resaltar que este proceso se realizó en una sola audiencia de dos horas, bajo los alcances del sistema de la oralidad civil, lo que permitió brindas una respuesta oportuna y eficiente a la demandante.
El magistrado Sierra Casanova manifestó que gracias a las constantes capacitaciones brindadas por el Programa Distrital de Acceso a la Justicia de Personas en Condición de Vulnerabilidad y Justicia en tu Comunidad, se pueden emitir este tipo de pronunciamientos con enfoque de género, que respetan los derechos e intereses de las personas en condición de vulnerabilidad.
Es importante precisar que el juez, antes de emitir la sentencia, revisó los antecedentes de la demandante, el registro de deudores alimentarios y otros requisitos necesarios propios del proceso.
Además, dentro del Programa Acceso a la Justicia, se busca proteger y brindar una adecuada atención a las víctimas de violencia, a través de una intervención conjunta intersectorial, aplicando el Sistema de Protección Internacional y Nacional sobre discriminación y violencia de género.
De esta manera, la Corte Superior de Cusco, que preside la magistrada Yenny Margot Delgado Aybar, promueve la protección de los derechos humanos y trabaja de manera conjunta para erradicar la discriminación en la sociedad, en especial de aquel sector vulnerable.

Magistrate Sierra Casanova stated that thanks to the constant training provided by the District Program of Access to Justice for People in a Condition of Vulnerability and Justice in your Community, this type of pronouncements with a gender perspective can be issued, which respect the rights and interests of people in vulnerable conditions.
It is important to specify that the judge, before issuing the sentence, reviewed the plaintiff’s background, the registry of maintenance debtors and other necessary requirements of the process.
In addition, within the Access to Justice Program, it seeks to protect and provide adequate attention to victims of violence, through a joint intersectoral intervention, applying the International and National Protection System on discrimination and gender violence.
In this way, the Superior Court of Cusco, chaired by Judge Yenny Margot Delgado Aybar, promotes the protection of human rights and works together to eradicate discrimination in society, especially in that vulnerable sector.
