Así lo estableció hoy a través de la Resolución Administrativa N.° 000337-2021-CE-PJ tras una reunión virtual de sus integrantes.
El órgano de gobierno judicial considera que para el ámbito penal no hay día ni hora inhábil, según lo normado en el artículo 126 del Texto Único Ordenado de la Ley Orgánica del Poder Judicial concordante con el artículo 117 del Código Procesal Penal.
Asimismo, precisa que en los procesos no penales, las audiencias programadas en la fecha indicada, el lunes 11 de octubre, se realizarán si se cuenta con la concurrencia de las partes procesales.
En ambos casos, indica la disposición, se habilita el referido día para los fines de las audiencias y no afectar el cómputo de los plazos procesales.
Añade que en los procesos no penales en que no concurran las partes procesales o solamente acuda una de ellas, las audiencias se reprogramarán dentro de los 10 días hábiles siguientes.
Finalmente, dispone que la Oficina de Control de la Magistratura (OCMA) y las Oficinas Desconcentradas de Control de la Magistratura (Odecma) supervisen el cumplimiento de esta medida.
Cabe indicar, que el Poder Ejecutivo mediante el Decreto Supremo N.° 161-2021-PCM declaró, entre otros, día no laborable el lunes 11 de octubre de 2021.
